How Social Media Giveaway Rules Differ From Official Sweepstakes

Learn what Facebook, YouTube and TikTok require beyond free entry, and how to spot a complete rules post.
Social media giveaways differ from formally structured sweepstakes because they must follow platform rules in addition to basic sweepstakes law. A formal sweepstakes centers on complete written rules and free entry with equal odds, while a social post adds releases, sponsor statements and feature limits. A sweepstakes is a prize promotion where winners are chosen by chance.
Social giveaways often use that same chance format, but the post caption is not enough to make the promotion complete.

What keeps a sweepstakes lawful?
A promotion that combines prize, chance and payment to enter is an unlawful lottery in the United States. Lawful sweepstakes keep prize and chance but remove payment through free entry with equal winning odds, according to Federal Trade Commission consumer guidance in FTC guidance on prize promotions. That means asking followers to buy a product to enter creates legal risk.
A free alternate entry method with the same chance to win avoids that problem.
What does Facebook require for a promotion?
Meta requires promotions on a Facebook Page, Group or Event to include a release of Meta by each entrant. Entrants must also acknowledge that Meta does not sponsor the promotion, as stated in Meta promotion rules for Pages, Groups and Events. The sponsor remains responsible for lawful rules, eligibility terms and compliance.
Facebook does not approve the giveaway or resolve entry disputes. Readers should look for those three items before entering:
- who is sponsoring the prize and how to contact them
- who may enter, start and end dates, and how winners are picked
- a statement that Facebook is released and is not a sponsor
What does YouTube require for a contest?
YouTube requires every contest on or using YouTube to publish complete Official Rules. Those rules must link to the Community Guidelines and state that violations can bring disqualification, according to YouTube Help in YouTube contest rules. The rules must also state that YouTube is not a sponsor and include a liability release.
A video description that says only comment to win does not meet that standard.
Why are TikTok Shop giveaways narrower?
TikTok Shop giveaways must be entirely free and run through its official LIVE Giveaway feature. Prize value must stay below the set limit, according to the TikTok Shop Academy in TikTok Shop giveaway and promotion policy. Cash, virtual currency and gift cards cannot be offered as prizes there.
A creator promising cash through that Shop feature is not following the current Shop policy.
