Holiday Giveaways on TikTok: What the Rules Must Disclose

Check any TikTok holiday giveaway for sponsor, entry dates, prize value, odds, and free entry before you post.
Holiday giveaways on TikTok must disclose sponsor identity, eligibility, entry method and dates, prize descriptions with value, odds, and winner selection and notification. They must also disclose any payment or incentive behind creator posts and offer a free entry path when chance decides winners. A sweepstakes is a chance-based prize drawing where winners are picked at random.
A material connection is any financial, employment, personal, or family tie between a creator and a brand, including free products or contest entry given for promotion.

Who has to disclose a holiday promotion?
Any creator paid or incentivized by a third-party brand must treat the post as branded content. That includes gifted products, affiliate commissions, and ambassador ties. According to TikTok, those creators must enable the commercial-content disclosure toggle so the post is auto-labeled, as described in TikTok's branded content policy.
The same duty applies under federal endorsement rules. According to the FTC staff guide, any material connection must be made obvious to viewers, as explained in the FTC's Disclosures 101 brochure. A free holiday bundle counts even if no cash changes hands.
Where must the disclosure appear?
For video giveaways, the disclosure belongs inside the video itself, not only in the caption. According to FTC staff, it should come early and use plain language such as ad, sponsored, or thanks to a named brand for the free product, as explained in the FTC's Disclosures 101 brochure. Viewers may never open the description.
Livestreams need repetition because people join at different times. Restate the tie to the sponsor during the stream. Keep on-screen text and spoken wording simple and easy to catch.
What must the written rules spell out?
Clear rules prevent deception. They should name the sponsor, list who may enter, explain how to enter, give start and end dates, and describe each prize with approximate retail value. They should also state odds or that odds depend on entries received, plus how and when winners are picked and notified.
Use this quick check before you enter: A chance-based holiday offer must remove purchase or other required payment to avoid running as an unlawful lottery. Sponsors should provide a free alternate entry method and state that purchase will not improve odds.
- Sponsor name and eligibility limits are stated
- Entry steps, limits, and dates are listed
- Prizes, quantities, and values are described
- Odds and winner contact method are explained
- Free entry path is stated, with no purchase needed to win
What if entry requires posting about the product?
When entry requires posting about the sponsor's product, those entrant posts count as endorsements made for a chance to win. According to the FTC, sponsors must instruct entrants to disclose participation, for example by adding a tag like #XYZ_Sweepstakes in the entry message, as explained in the FTC's endorsement FAQs. Read the entry instructions for that exact hashtag or phrase.
Copy it without edits or added claims. If the instructions lack disclosure wording, add your own clear line that the post is a sweepstakes entry.
