Gift Card Giveaway vs Rebate: When You Have to Make a Purchase

Learn how chance, purchase conditions, and submission rules separate gift-card sweepstakes from rebates and rewards.

A purchase requirement usually means a gift-card offer is a rebate, premium, or promotional rewardβ€”not a chance-based sweepstakes. If chance determines who receives the card, a purchase cannot be required to enter or improve the odds. The label "gift card giveaway" is often too vague to settle the question.

Check whether every qualifying buyer receives a card or only selected entrants have a chance to win.

Does chance determine who gets the card?

A sweepstakes awards a prize based on chance and must offer a way to enter without paying or making a purchase. The U.S. Postal Service explains that sweepstakes have no required purchase or entry fee, and a purchase cannot improve an entrant's odds in its Publication 546 guidance.

For example, "Buy this product for a chance to win a $100 gift card" needs a no-purchase entry route. The official rules should explain that route and give purchasers and non-purchasers equal odds. "No purchase necessary" does not mean everyone receives something.

It means eligible people may enter without buying, while chance still determines the winner.

When is the card a guaranteed purchase reward?

If every customer who meets the stated purchase conditions receives the same gift card, chance is absent. USPS classifies this structure as a premium offer rather than a sweepstakes. A qualifying condition might involve buying a specified product and following the offer instructions.

The card is a promised benefit tied to compliance, not a prize someone might win. Look for firm language such as "receive," "get," or "earn," but do not rely on the headline alone. The terms must confirm that every eligible customer who completes all requirements receives the stated reward.

Is it a rebate or another promotion?

A rebate returns value after a purchase, often after the customer submits required information. The Consumer Financial Protection Bureau's Regulation E guidance expressly recognizes rebate programs that provide a card after someone purchases a product or service and completes the submission process. Not every purchase-linked card is a rebate.

The same guidance separately recognizes promotional cards awarded for purchases, visits, referrals, sales promotions, and other incentives. The practical difference often lies in the offer's structure:

  • Rebate: Buy the qualifying item, submit the required material, and receive a card.
  • Premium offer: Complete the stated purchase condition and receive the same gift as every qualifying customer.
  • Promotional reward: Earn a card through a purchase, visit, referral, or similar activity.
  • Sweepstakes: Enter for a chance to win, with a no-purchase entry method available.

What should you check before buying?

Read the full terms before treating the card as part of the product's value. The Federal Trade Commission says rebate advertising should prominently show the pre-rebate price and rebate amount, while clearly disclosing purchase requirements, fees, and expected delivery timing in its advertising guidance. Check these points before paying: Promotional cards must identify their promotional purpose.

Where applicable, the card must also disclose the funds' expiration date, fees and conditions, and contact details for fee information.

  • Whether the card is guaranteed or awarded by chance
  • Which products, purchase dates, and customers qualify
  • Whether registration, receipts, codes, or other submissions are required
  • The submission and redemption deadlines
  • Delivery timing and possible fees

Why the wording matters

Find the official rules and verify whether the purchase triggers a certain reward or merely appears beside an optional chance to win.
